Here’s a breakdown of the key stages in the legal process of buying a new home:
Step one: Offer acceptance, instructing a solicitor and finalising the mortgage
As soon as you’ve made an offer and it’s accepted, the first step is to appoint a solicitor or licensed conveyancer. Their role is to handle all legal aspects of the property transfer, including conducting searches, reviewing contracts, and liaising with the seller’s solicitor.
If you’re using a mortgage, the lender will require a valuation of the property and may request additional documentation. Once your application is approved, you’ll receive a mortgage offer, which your solicitor will review to ensure the terms align with the property purchase.
Step two: Reviewing the draft contract
The seller’s solicitor will prepare the draft contract documentation and share it with your legal representative. Your solicitor will carefully examine it, checking details such as property boundaries and the fixtures and fittings included.
They will also check whether the property is subject to any restrictions, rights, or legal easements you need to be aware of.
They will then raise any necessary enquiries to clarify terms or resolve issues before proceeding.
Your legal representative will also carry out property searches. These searches uncover information not obvious from a viewing and usually include:
- Local authority search – checks for planning or building regulations.
- Environmental search – identifies flood risks, land contamination, etc.
- Water and drainage search – confirms the property’s connections to mains services.
These searches are crucial for identifying potential legal or environmental complications.
Once the legal research is complete, your legal representative will prepare a report for you so that you have the chance to raise any questions before committing to the purchase.
Step three: Exchange of contracts
Once all enquiries are resolved, your mortgage is in place, and all parties have agreed on a completion date, you will be ready to proceed to exchange of contracts. This is a legally binding step, and you’ll pay a deposit (typically five to 10 per cent of the purchase price).

On the day of completion, your solicitor transfers the remaining funds to the seller’s solicitor. Once received, ownership officially changes hands, and you can collect the keys to your new home. Your solicitor will then:

- Send you the title deeds and any remaining legal documentation
